General Terms and Conditions of Business

By accessing and using this service, you accept and agree to be bound by the terms and provision of this agreement. In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services. Any participation in this service will constitute acceptance of this agreement. If you do not agree to abide by the above, please do not use this service.

1. Terms of Use

Colleen Kersey may from time to time revise these Terms and Conditions without notice. You should occasionally review this page so you are aware of any such revisions. If you fail to comply with the Terms and Conditions, I reserve the right to terminate our working relationship.

2. Disclaimer

I am an Animal Communicator, Spiritual Coach, Tarot teacher and mentor, and Reiki Practitioner.

I am not a doctor, vet, or medical professional, financial advisor, lawyer, or psychotherapist or counsellor, and I therefore do not offer medical, financial, legal, or psychological advice.

The information that I give clients is done in an attempt to provide them with more information about their situation so that they feel better informed and therefore more empowered to make their own decisions. I may advise that clients contact a relevant professional.

3. Client Responsibility

Any person suffering from a medical condition, should consult their G.P.
Any person suffering from financial problems, should consult their bank or financial advisor.

Any person in a legal predicament, should consult their legal assistance or lawyer.
Any person suffering from depression or mental illness, should consult their G.P. or counsellor.
Any person who presents a physically ill animal for an animal communication session or Reiki treatment, will be advised to contact their vet. If I feel that the animal will benefit more from behavioural training, that will be recommended.

4. Website

I make no warranty or representation that my website will meet your requirements, that it will be of satisfactory quality, that it will be fit for a particular purpose, that it will not infringe the rights of third parties, or that it will be compatible with all systems. I make no guarantee of any specific results from the use of my services.

No part of this website is intended to constitute medical, financial, legal, or psychological advice and the content of my website should therefore not be relied upon to make any decisions in those matters.

Whilst I use reasonable endeavours to ensure that this website is secure and free of errors, viruses and other malware, all users are advised to take responsibility for their own security, that of their personal details and their computers.

5.1 Why I Need Your Information and How I Use It

I rely on a number of legal bases to collect, use, and share your information, including:

as needed to provide my services, such as when I use your information to contact you, process your order, or to provide customer support
when you have provided your affirmative consent, which you may revoke at any time, such as by signing up for my mailing list;
if necessary to comply with a legal obligation or court order or in connection with a legal claim, such as retaining information about your purchases if required by tax law; and
as necessary for the purpose of my legitimate interests, if those legitimate interests are not overridden by your rights or interests, such as providing and improving my services. I use your information to provide the services you requested and in my legitimate interest to improve my services.

I will never disclose any of this information to third parties without your prior consent. Ever!

5.2 Data Retention

I retain your personal information only for as long as necessary to provide you with my services. However, I may also be required to retain this information to comply with my legal and regulatory obligations, to resolve disputes, and to enforce my agreements.

5.3 Your Rights

If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. I describe these rights below:

Access. You may have the right to access and receive a copy of the personal information I hold about you by contacting me using the contact information below.
Change, restrict, delete. You may also have rights to change, restrict my use of, or delete your personal information. Absent exceptional circumstances (like where I am required to store data for legal reasons) I will generally delete your personal information upon request.
Object. You can object to (i) my processing of some of your information based on my legitimate interests and (ii) receiving marketing messages from me after providing your express consent to receive them. In such cases, I will delete your personal information unless I have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons.
Complain. If you reside in the EU and wish to raise a concern about my use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.

6. Bookings

When you express interest in an animal communication session, you are not committed until such time as I receive payment. Once you have agreed to purchase a session, I will provide a link for you to purchase the service via PayPal on my website.

Once you PAY for the service, you have then committed and the cancellation, reschedule and refund conditions apply.

For all appointments, payment must be received in full, before the session commences.

6.1 Cancellation Policy / Refunds

‘Colleen Kersey’ Rescheduling: I will make every reasonable effort to complete the services in accordance with the scheduled date that I have given you. I cannot, however, be held responsible for any delays if an event occurs outside of my control, preventing me from doing so.

I will always do my best to re-schedule appointments.

Any Client Cancellations for appointments, must be made via email. 

When you purchase an animal communication session, you will be informed when I have scheduled the session. You cannot cancel after this date, as the session will already have been done. If you cancel WITHIN 24 hours of this day (flexibility allowed), you will still be charged a portion of the price UNLESS I can fill that slot with a waiting client.

Alternatively, the amount that you paid, can be held in credit for you to use at another more convenient time. 

If you are late for your video feedback appointment for an animal communication session, that will eat into your time slot. I.e., if you are 20 minutes late for an hour slot, you will only have 40 minutes remaining. My calendar is full and I unfortunately don’t have a lot of buffer time to run over.  

Refunds: Refunds are not offered on animal communication sessions. If, for any reason, you are unhappy with your reading, please get in touch because sometimes the information that I have provided just needs clarification or deeper explanation.

6.2 Payment

I do review my price structure throughout the year, and I reserve the right to change them without prior notice.

I accept payment via all major debit and credit cards with the transaction handled by PayPal. I can make arrangements for internet banking/bank transfers for French clients only.

I reserve the right to terminate our agreement with you if I am refused authority from your card issuer for payment. You agree to compensate me in full against any and all reasonable costs and expenses that I may incur in obtaining payments due from you that you have not made in accordance with your agreement with me.

I am not responsible for charges received in a client’s bank account that results from insufficient funds due to payments or subscription charges that were charged on the correct due date. Clients are responsible for ensuring their credit card information is up-to-date.

7. Third Party Rights

Nothing in these Terms and Conditions shall confer any rights upon any third party. The agreement created by these Terms and Conditions is between you and me.

8. Copyright

All content provided to you, by me, i.e., animal communication session notes, are the property of Colleen Kersey. You may only copy or use it for your own purposes if you have purchased it directly from me.

All content including the physical website design, text, graphics, logos, icons, images, sound clips, video clips, page layout, underlying code and software is the property of Colleen Kersey, or other relevant third parties. By continuing to use the website you acknowledge that such material is protected by applicable International intellectual property and other relevant laws.
